ESTATE PLANNING & WILLS

Every person should have an Estate Plan in place, in the event of death or disability.  A basic Estate Plan is very affordable. 

 

Some of the important documents  are as follows:

 

 A Will is a document where you determine the legal disposition of your property upon death. In a Will you name a Personal Representative, which is a person who is charged with administering your Estate under the terms of your Will. If you have minor children, you will also name a Guardian of the children.

 

If you have minor children, it is advisable to have a Family Trust. The Trust would provide a mechanism for assets to be managed until the child/children were of appropriate age. In this document you would also name a Trustee of the Trust. 

 

A Health Care Proxy is a document where a Health Care Agent is named to make health care decisions for you if you are unable to make health care decisions on your own.

 

A Living Will is a document that is in addition to a Health Care Proxy. You would execute this document to provide a written instructions to your Health Care Agent regarding any extraordinary medical procedures in the event of terminal illness/injury or incapacity.

 

A Power of Attorney is a document in which you name a person to act for you in all non-health care related decisions, including financial matters, particularly in the event of incapacity or disability.

 

Other Estate Planning issues involve Deeds, Life Estate Deeds, Realty Trusts, Declarations of Homestead, Revocable Trusts and Irrevocable Trusts.

PROBATE, ESTATES & TRUST ADMINISTRATION

 

When a person dies in Massachusetts, their property and assets may have to be administered through the Probate Court.  A Personal Representative (formerly called an Executor or Administrator) must also be appointed. There are a number of different types of Estates in Massachusetts. Depending on the size of the Estate, assets involved and issues presented.  Attorney McGoldrick will work with you to resolve your Estate issue in an expeditious and cost effective manner, including: 

 

Informal Probate

Formal Probate

Voluntary Probate 

 

Some assets are held in a trust and no Probate filing is necessary. Attorney McGoldrick has significant experience with Trust Administration as well. 

 

Massachusetts Probate Practice and Trust Administration often involve the sale, conveyance or distribution of Real Estate.  Attorney McGoldrick has practiced Real Estate Law for many years.

Attorney McGoldrick has represented hundreds of Real Estate buyers, sellers and lenders in residential real estate transactions and closings over the years.

CRIMINAL DEFENSE

Attorney McGoldrick has has decades of experience in the Courts and the Massachusetts Criminal Justice System dating back to 1987.  He has served on the District Court Panel of the Committee for Public Counsel Services (CPCS) since 1994.

Attorney McGoldrick has been a member of Middlesex Defense Attorneys since 1994. 

 

At this time, Attorney McGoldrick is limiting his criminal law practice to Court Appointed cases only. Should you need a criminal defense attorney, you may contact Attorney McGoldrick for a referral. 

GENERAL PRACTICE

 

WATERTOWN LICENSING BOARD

 

Attorney McGoldrick  has practiced before the Watertown Licensing Board since 1998.

Most businesses have to file an application and appear before the town Licensing Board to get the appropriate Business License approved.  Attorney McGoldrick has worked with the Town Licensing Board on the application forms and process, as well as representing parties before the Licensing Board to obtain the desired license.  

 

Particularly in Alcohol License cases, the Licensing Board may also discipline existing businesses if they are alleged to have committed licensing violations.  Attorney McGoldrick has successfully defended clients before the Board, often reducing or eliminating potential license suspensions.

LABOR LAW

Since 2014, Attorney McGoldrick has represented Labor Unions in Arbitration and Unfair Labor Practice cases before the Massachusetts Department of Labor Relations.

ATTORNEY PROFILE

Attorney McGoldrick is a lifelong Watertown resident, and is married to Theresa Fahey McGoldrick Esq. Theresa and Tim have two children, Emma and Matthew.

 

Tim is a 1988 graduate of Boston College, with a B.A. in Sociology, and a 1991 Honors Graduate of Suffolk University Law School, with a Juris Doctor – Cum Laude. He has been licensed to practice law in Massachusetts since 1991.

 

Following Law School Tim was appointed to serve as a Law Clerk to the Justices of the Massachusetts Superior Court.  He then worked as an associate for six years at Nigro, Pettepit & Lucas, LLP, a general practice law firm in Wakefield, MA.  Tim started his own practice in 1998 in Watertown.

 

Tim is very active in the community, and serves on the Board of the Sonny Whooley Foundation.  He also served on the Hosmer Elementary School Site Council for six years, the last three as Parent Chair Person. 

 

Tim is also a Watertown Youth Sports Coach, having coached 21 seasons of Baseball, Soccer and Basketball from 2010-2019.
